This year’s Conference theme was “Towards Mutual Gain: Navigating Party Interests in Arbitration”. Arbitration is widely recognised for ensuring party autonomy, providing procedural flexibility, and delivering efficient resolutions with predictable costs. However, its potential to align with and prioritise parties' interests, a core element of other methods of alternative dispute resolution, remains underexplored. This year’s ICC European conference explored to what extent arbitration can transcend its traditional role to consider not just the rights but also the broader interests and objectives of the parties involved. Does it have the capacity to shift from a zero-sum game to a more holistic approach that seeks mutually beneficial solutions?
