José Luís Moreira da Silva participates in the Advocatus Summit, in Oporto

José Luís Moreira da Silva, Partner at SRS Legal, participated in the Advocatus Summit, in Porto, on 17 October.

In a panel dedicated to the topic "Tax transparency regime for lawyers", moderated by Frederico Pedreira, journalist from Advocatus/ECO, also composed by José Alves do Carmo, partner at AVM Advogados, and Matilde Freitas Fortes, tax consultant at AVM, José Luís Moreira da Silva spoke about this regime, in his capacity as President of ASAP - Association of Law Firms of Portugal.

The lawyer stressed that the name "fiscal transparency" is misleading and that, more than the regime itself, it is the name that has prevented some changes to article 6 of the Portuguese IRC Code. "There is a regime here that is clearly conducive to inequality, unfair competition and profound iniquity," he stressed, also recalling that reality has changed and that the law has not adapted to this reality. "Today we have law firms that are real companies and cannot continue to be treated as they were in 1989 when they were just colleagues who got together".

O advogado sublinhou que o nome “transparência fiscal” é enganoso e que, mais do que o próprio regime, é o nome que tem impedido algumas alterações ao artigo 6.º do Código do IRC. “Há aqui um regime claramente propiciador de uma desigualdade, de uma concorrência desleal e de uma profunda iniquidade”, sublinhou, relembrando também que a realidade mudou e que a lei não se adaptou a essa realidade. “Hoje temos sociedades de advogados que são verdadeiras empresas e não podem continuar a ser tratadas como regimes de 1989 em que eram apenas colegas que se juntavam”.
