Luís Neto Galvão coordinates "Transatlantic Data Privacy Framework (TADPF) – Solução ou Problema adiado?" APDSI Webinar

Luís Neto Galvão, Partner at SRS Advogados, coordinated and moderated the Transatlantic Data Privacy Framework (TADPF) - Solution or Postponed Problem? debate Webinar, on 30 June, under the scope of the DSA, DMA, e-Privacy Mission Group of APDSI - Associação para a Promoção e Desenvolvimento da Sociedade da Informação, part of the #RegulaçãoDigital Cycle.

As Coordinator of the Digital Markets Act, Digital Services Act and e-Privacy Group of APDSI, Luís Neto Galvão moderated a panel composed by Shane Murphy (Privacy Policy Manager of META for Europe, Middle East and Africa), Graça Canto Moniz (Professor of Law, Universidade Lusófona, Nova School of Law), Sebastião Barros Vale (EU Policy Counsel at Future of Privacy Forum) and Sofia Riço Calado (Senior Legal Counsel at Cloudflare).
 
This debate follows the announcement in March 2022 by the European Commission and the US administration of a new agreement on transfers of personal data to the United States of America (USA), the Transatlantic Data Privacy Framework.
Ursula Von der Leyen, President of the European Commission, enthusiastically praised the qualities of the agreement, which will allow predictable and trusted data flows between the European Union (EU) and the US, safeguarding privacy and civil liberties.
For his part, US President Joe Biden said the agreement will improve the Privacy Shield framework and promote growth and innovation in the EU and US, as well as help businesses compete in the digital economy.
Contrasting this optimism, Austrian activist Max Schrems - founder of the NGO Europe versus Facebook - considered that the new text could "be back in court within months", adding that it is "unfortunate that the EU and the US have not used this situation to reach a no-spying agreement with basic guarantees between like-minded democracies".
 
With this background the coordinator and panellists discussed the state of play on the difficult issue of international data transfers, in particular to the United States of America.

"As a lawyer, international transfers of personal data, in particular to the United States are a problem experienced daily by my clients. The debate has shed some light on the huge challenges at stake. APDSI is to be congratulated!", stated Luís Neto Galvão after the end of the event.
