The Banking and Finance Department of SRS Legal has published a newsletter dedicated to the recent Decree-Law No. 77/2026, which introduces important changes to the legal regime governing credit securitisation.
This legislation aims to modernise and clarify the framework for securitisation in Portugal, bringing it closer to European standards and expanding financing possibilities for companies. Among the main changes are the redefinition of the concept of securitisation, the express admission of the securitisation of bonds and other securities, as well as new solutions that facilitate SMEs' access to the capital market.
This new regime also strengthens the link with Regulation (EU) 2017/2402, promoting greater consistency between national law and the European framework applicable to securitisation.
