‘Porta 65 grants are being held up due to a condition not provided for in the law’ (with Regina Santos Pereira)

«Regina Santos Pereira, a Partner at SRS Legal, supports this view. ‘The law structures the support in 12-month cycles, but does not require the tenancy agreement to have a minimum duration of 12 months. The legislation providing for this support contains no provision making access to Porta 65 contingent on a minimum contractual term.’ Thus, she considers that the reference on the Housing Portal will be “merely a practical recommendation or management guidance on the type of contracts best suited to the design of the support, and not ‘an additional eligibility requirement’. In this scenario, she admits, the IHRU would be violating the ‘principle of legality’.»
